These Terms of Service (“Terms”) govern your use of the Match Planner mobile application (“Match Planner”, “the App”). The App is operated by Lemonkode (Pty) Ltd (registration no. 2018/286587/07), of Quinan House, 12 de Beers Avenue, Paardevlei, Somerset West, 7130, Western Cape (“we”, “us”). These Terms form an electronic agreement under the Electronic Communications and Transactions Act, 2002 (ECTA). By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use the App.
Match Planner welcomes bowls players of all ages, including juniors. Some features rely on a valid Bowls SA (BSA) membership number.
If you are 18 or older, you can register and use the App yourself. Junior players under 18 are welcome too — a parent or legal guardian simply needs to agree to these Terms and the Privacy Policy on their behalf and supervise their use, because South African law (POPIA) requires a “competent person” to consent before a child’s information is processed.
When using the App, you agree not to:
Match Planner is a tool for arranging matches and recording scores. You are responsible for the accuracy of any match, score or result you enter. Results may require confirmation by your opponent and may be shared with the relevant clubs and tournament organisers, and used to update statistics, experience points (XP) and standings. We do not adjudicate sporting disputes; the official record for any competition remains that of the relevant club, league or tournament body.
The App is currently provided free of charge. If we introduce paid features or subscriptions in future, we will present the applicable pricing and additional terms to you before you incur any charge, and any such purchase will be processed through the relevant app store.
The App, its name, logo, design and software are owned by Lemonkode (Pty) Ltd or its licensors and are protected by law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for its intended purpose. You retain ownership of the content you submit (such as your profile details and match data) and grant us the licence needed to operate the App and provide the service to you and the other players involved.
The App is distributed through the platforms operated by Apple and Google, and your use of those platforms is subject to their own terms. The App also relies on our hosting infrastructure provider to operate. We are not responsible for third-party services we do not control.
We aim to keep the App available and working well, but we provide it on an “as is” and “as available” basis and do not guarantee that it will be uninterrupted or error-free. To the extent permitted by law, we disclaim implied warranties. Nothing in these Terms limits or excludes any rights you have that cannot lawfully be excluded, including your rights under the Consumer Protection Act, 2008 (CPA).
To the maximum extent permitted by South African law, we will not be liable for any indirect, incidental or consequential loss arising from your use of (or inability to use) the App, including any loss arising from inaccurate match data or results. This clause does not exclude liability that cannot be excluded by law, including under the CPA or for gross negligence.
We may suspend or terminate your access to the App if you breach these Terms, misuse the App, or where reasonably necessary to protect other users or our systems. You may stop using the App and delete your account at any time.
Our handling of your personal information is described in our Privacy Policy, which forms part of these Terms.
We may update these Terms from time to time. We will revise the “Last updated” date above and, where changes are significant, provide notice in the App. Continued use of the App after an update means you accept the revised Terms.
These Terms are governed by the laws of the Republic of South Africa, and you consent to the jurisdiction of the South African courts. We encourage you to contact us first at support@matchplanner.io so we can try to resolve any dispute informally.
We may transfer or assign these Terms, and our rights and obligations under them, to an affiliated or successor company — for example, as part of a reorganisation or the transfer of the App to a dedicated Match Planner company. We will notify you in the App or by other reasonable means if the operator of the App changes, and your rights under these Terms and our Privacy Policy will be preserved. You may not transfer your account or these Terms to anyone else without our consent.
